General registration conditions

Unless otherwise stipulated, our services are provided under the following general conditions of sale

ARTICLE 1

The purpose of the general conditions of sale is to define the terms of negotiation, conclusion and execution of any contract aimed at the provision of a service falling within the scope of Art.L 900-2 of the code work or any related service.

ARTICLE 2

These general conditions of sale are concluded between our association hereinafter called “ABC FORMATION” declared for its continuing professional training activity under the Siret : 341 239 515 000 32 /A.P.E. :  n° 8559 A and the company, institution or individual applicant (after this referred to as “client”) accessing our services.

ARTICLE 3

The training services delivered by “ABC FORMATION” are carried out in accordance with the customer’s order. The content of the action as well as all the specific conditions are detailed beforehand in a proposal given to the client, this proposal being equivalent to an offer of service.

ARTICLE 4

The request for access to the “ABC FORMATION” service offer is proven as soon as the client has returned their training offer or notified by any other means that they have deemed fit to use as long as their identification is possible.

ARTICLE 5

Except in cases of force majeure, in the 8 days preceding the action, a document relating to the organization of the service (determining in particular the dates, times, places of training) is communicated to the client, it is their responsibility to notify the participant(s).

ARTICLE 6

At the end of the action, “ABC FORMATION” issues a training certificate and sends it to the client.

If validation tests are planned and in the event of success in these, he also receives either an approved title, a diploma, a qualification certificate or any other document validating success in the test.

ARTICLE 7

Unless otherwise agreed between "ABC FORMATION" and the customer signing the order, in the event of cancellation or postponement of dates by the customer, fixed costs, the amount of which cannot under any circumstances be taken into account. charged by an OPCA, will be invoiced to it. These various costs are subject to the notice period, i.e. – The same day of the training action: the entire order will be invoiced to the customer.

  • Between the day before and the 7th calendar day preceding the training action: “ABC FORMATION” will invoice the customer a lump sum of 75% of the amount of the order initially planned, with a minimum of €150 including tax.
  • Between the 8th and 20th calendar day preceding the training action: “ABC FORMATION” will invoice the customer a lump sum of 50% of the amount of the order initially planned, with a minimum of €100 including tax.
  • Before the 20th calendar day preceding the training action: “ABC FORMATION” will invoice the client a lump sum of €75 including tax (for management costs).

Any cancellation or postponement must be expressly notified to “ABC FORMATION”.

Unless otherwise agreed between “ABC FORMATION” and the client, in the event of absence of a registered trainee or abandonment during training, the full training costs will be invoiced to the client.

ARTICLE 8

Certain circumstances may result in “ABC FORMATION” either canceling an action or postponing it, particularly for educational reasons or in the event of force majeure.

In this case, the client is notified, except in cases of force majeure, at least one week before the start of the training action and cannot therefore claim any compensation.

However, “ABC FORMATION” undertakes to quickly reconnect with the client to offer new dates for carrying out the action or a similar action.

ARTICLE 9

Except in special cases for which invoicing would precede the performance of the service, each action is the subject of one or more invoices. The invoice is sent to the customer or their paying agency.

Each invoice relating to services and related costs is payable no later than the due date, i.e. 45 days from the invoice date. After the payment due date and in accordance with articles 441-6 c. com and D. 441.5 c. com., any late payment automatically entails, in addition to late payment penalties of 3 times the legal interest rate plus 10 percentage points on the amount including tax, an obligation for the debtor to pay a fixed compensation of €40 as well as additional compensation which may be claimed, upon supporting documentation, when the recovery costs incurred exceed the amount of the fixed compensation.

ARTICLE 10

In the event of a dispute and in the absence of an amicable solution, the competent jurisdiction is that of the headquarters of “ABC FORMATION”.

ARTICLE 11

The express or implicit acceptance of the action proposal by the company, the institution or the individual applicant automatically constitutes acceptance by him of these general conditions. Furthermore, no clause in the general conditions of the company or institution may be opposed to “ABC FORMATION” unless it has expressly accepted it.

ARTICLE 12

Payments made by bank card (Visa or Mastercard) will be made through the secure SystemPay system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can become aware during transport on the network. We do not have access to your bank details at any time.
