Unless otherwise stipulated, our services are provided under the following general terms and conditions.
The general terms and conditions of sale are intended to define the terms of negotiation, conclusion and execution of any contract for the provision of services falling within the scope of Art. L 900-2 of the Labour Code or any related services.
These general terms and conditions of sale are concluded between our association hereafter referred to as "ABC FORMATION", registered for its continuing professional training activity under SIRET: 341 239 515 000 32 / APE: 8559 A, and the company, institution or individual applicant (hereafter "client") accessing our services.
Training services provided by "ABC FORMATION" are carried out in accordance with the client's order. The content of the course and all specific conditions are detailed in advance in a proposal submitted to the client, this proposal constituting an offer of service.
The request to access the service offer of "ABC FORMATION" is confirmed once the client has returned their training offer or indicated by any other means that their identification is possible.
Except in cases of force majeure, within 8 days prior to the course, a document relating to the organisation of the service (including dates, times and venue) is communicated to the client, who is responsible for informing the participant(s).
Upon completion of the course, "ABC FORMATION" issues a training certificate and sends it to the client. If validation tests are planned and passed, the participant additionally receives either an approved title, diploma, qualification certificate or other document validating the test result.
Unless otherwise agreed, in the event of cancellation or postponement by the client, flat-rate fees not chargeable to any OPCA will be invoiced according to the notice period:
Any cancellation or postponement must be expressly notified to "ABC FORMATION". Unless otherwise agreed, in the event of absence or course abandonment, the full training fees will be invoiced.
Certain circumstances may lead "ABC FORMATION" to cancel or postpone a course, particularly for pedagogical reasons or force majeure. The client will be notified at least one week in advance (except force majeure) and may not claim any compensation. "ABC FORMATION" undertakes to contact the client promptly to propose new dates or a similar course.
Each course gives rise to one or more invoices payable within 45 days from the invoice date. After the due date, late payment automatically incurs penalties of 3 times the legal interest rate plus 10 percentage points on the total amount, plus a flat-rate recovery fee of €40 and any additional justified recovery costs.
In the event of a dispute and in the absence of an amicable solution, the competent court is that of the registered office of "ABC FORMATION".
Express or implied acceptance of the service proposal by the company, institution or individual applicant automatically constitutes acceptance of these general terms and conditions. No clause from the client's own general terms may be enforced against "ABC FORMATION" unless expressly accepted by it.
Credit card payments (Visa or Mastercard) are processed via the secure SystemPay system using SSL (Secure Socket Layer) protocol, ensuring that transmitted information is encrypted and cannot be accessed by any third party during network transmission. We do not have access to your bank details at any time.
